The organisation s purpose is to advance social and public welfare, with a focus on Aboriginal peoples. Its purpose is set out in rule 2.1 of its constitution. The organisation does not itself directly undertake activities that advance social or public welfare. Instead, it facilitates the provision of the direct relief by others. The organisation is currently the legal owner of a property at 5 Wallis Street, Lawson, New South Wales (Lawson Property). The Lawson Property is leased to LinkUp (NSW) Aboriginal Corporation (ABN 99 73 805 429) (LinkUp NSW). LinkUp NSW is a registered charity with subtypes of another purpose beneficial to the community and public benevolent institution . LinkUp NSW uses the Lawson Property in pursuit of its charitable purpose and to facilitate its programs to assist Aboriginal people who have been directly affected by past Government policies, including being separated from their families and culture through forced removal, being fostered, adopted or raised in institutions. The organisation also has other assets, including investments, the income from which is applied in furtherance of its charitable purpose and the facilitation of LinkUp NSW s charitable purpose. The Commissioner s Interpretation Statement on Indigenous Charities (CIS) states: The Commissioner recognises the unique situation of Australia s Indigenous peoples and recognises their disadvantage. The Commissioner notes that the disadvantage suffered by Australia s Indigenous peoples is widely recognised and acknowledged, including by Australian governments, parliaments and the courts. The CIS goes on to confirm an organisation with the purpose of addressing Indigenous disadvantage will be registered with the purpose of advancing social or public welfare , unless the organisation seeks registration for another charitable purpose. This further aligns with the organisation s nominated purpose of advancing social or public welfare .
